| Copyright Guidelines |

Pickle expects that all uploaded photos and videos are original works, or that Pickle members have taken the
necessary steps to get permission for copyrighted content. Should we receive information that posted content
infringes on another’s copyright, the content will be taken down from Pickle and that user’s account may be terminated. Visit
the Pickle Terms and Conditions section of the site for further specific information regarding our copyright policies.

| Some Copyright Guidelines |
The language of copyright infringement and fair use laws can be difficult to navigate. However, the posting of unauthorized
copyrighted material can have serious consequences including the termination of your Pickle account, and even monetary fines
(if a copyright owner takes you to court). To help you avoid a potentially sticky situation we have put together some basic
guidelines about copyrighted material and fair use.
Please note: It is the intent of Pickle to foster a community for the sharing of original, creative work. The best
way to avoid copyright infringement entanglements is to post material that is all your own.
|
| What exactly is copyrighted material? |
As the name implies, copyright refers to the right "the owner" has to control who can use copies of his or her work
and how these copies can be used. Some examples of copyrighted material include (but are not limited to):
- Photos taken by someone else
- Music written or recorded by someone else
- TV shows
- Music Videos
- Videos and photos of live concerts (Even if it was personally captured by you.)
- Movies and movie trailers
- Commercials or Advertisements (Print, TV, or Audio)
- Slide shows that contain photos, images, or music owned by someone else

| Common Copyright Misconceptions: |
Myth: If I downloaded the copyrighted material myself, then it is no longer under copyright.
Reality: No matter what method was used to capture the material it is still copyrighted. It remains
copyrighted material even if you taped it, downloaded it, or recorded it yourself.
Myth: If I give credit to the copyright owner then I can use copyrighted material.
Reality: Even if you credit the copyright owner, you are not authorized to post copyrighted material
without his or her explicit consent.
Myth: I’m not trying to make money off of the material, so copyright laws do not apply.
Reality: Monetary intent has no bearing on copyright law. Even if you are not trying to make a
profit off of the material, you are not authorized to post someone else’s work.
Myth: It is ok to use a small portion of a larger work of copyrighted material.
Reality: Any part of copyrighted work is protected under copyright law as well. It does not matter
if you use a short clip, a portion of a photo, or a measure of music, you are not authorized to post the
copyrighted material.
|
| What we do when we find Infringement: |
If Pickle is notified that any posted material infringes on another’s copyright, the material will immediately be removed
from the site. If you see material you believe infringes on your copyright please notify us as soon as possible. Users
who repeatedly and intentionally post copyright infringing content are subject to account suspension or termination as
required by law.
How does "fair use" work?
There are certain, specific circumstances when the use of a very short portion of copyrighted material in the
appropriate context may be legal, even without the copyright holder’s permission. This is what is referred to as
the "fair use" principle of copyright law.
To determine if the particular use of copyrighted material meets "fair use" standards please refer directly to
the copyright office of the United States government ( http://www.copyright.gov/fls/fl102.html ).
For more information about "fair use" we invite you to visit the following links:
Caution: "Fair use" is a very subjective section of copyright law. If a copyright owner believes that their material has been used in a way not compliant with fair use standards, they may choose to resolve the issue in court.
How you decide to interpret and exercise your fair use rights is solely at your discretion. PICKLE IS NOT RESPONSIBLE FOR YOUR FAIR USE DECISIONS OR ANY CONSEQUENCES OF THOSE DECISIONS.
